<p>Watching the debates go back and forth via news-commentary, as well  as within the offices of our Country&#8217;s government, it is appalling to me  to see that there are so many questions around the increase of troops  in Afghanistan.</p>
<p>I love our troops, God, I love our troops.  These are the people that  sacrifice their lives to defend our freedoms.  I can tell you right  now, that I, as a concerned citizen, want our soldiers to have the  PEOPLE and EQUIPMENT that they need to fight.</p>
<p>There is no greater insult to the men and women of our Country, than  to abandon them in their time of need.  Period.  It is disgusting.   I  am not a general, I am not the President, I am not a soldier, but I do  know, that those troops out there deserve their Country to back them,  and it better happen.  Or, in honor of Sarah Palin, I have to say, that,  there will be a very special place in hell for those people making  decisions that hurt our troops.</p>

<p>This is an article about a Scotch distillery that is using an  anaerobic digester to process a waste-product into an energy source for  the company.  This could save the business up to $175,000 per year!</p>
<p>The waste-product, called &#8220;pot ale&#8221; is basically water that is left  over after the alcohol is extracted.  The cost to dispose of such waste  ran the company around $30,000 per year.</p>
<p>Now, this company is using its waste to power up to 80% of its energy  needs &#8211; NOW THAT IS SUSTAINABLE, and not only that, it is better for  their bottom line.</p>

<p>We hope you have been paying attention to what bills and issues are  looked at in the House and Senate, because there is a positive  correlation with when politicians are up for election &#8211; if there are  contentious issues that may cost them seats, these bills are sent to the  back-burner.  If there is an issue that will win them votes, then it is  time for a marketing campaign!</p>
<p>Unfortunately, we have a whole lot of politicking and very little  representation.  We like to remain optimistic, but it is easy to see  that bad things happen when there are not checks and balances (hence our  constitution and the separation of powers which are so important to  protect).</p>
<p>Have you heard anything about the &#8220;Boss Tweed Era&#8221;?  It is a classic  example of politicking and bullying &#8211; something that we must be  cognizant of at all levels of politics.  We need representatives that  protect liberty and protect our constitution &#8211; period.</p>
<p>There are many great events and organizations rising to the occasion,  and we commend them!  Be sure to check out these people and groups that  are making strides to protect our liberties, and be wary of the  politics in play (find many of them in our blogroll).</p>

<p>And this is true &#8211; we are in very difficult times (The Good American   Post is made up of independent contractors and small businesses), but   this is no reason to throw in the towel &#8211; now it&#8217;s time to step up.</p>

			<content:encoded><![CDATA[<p>Absolutely not.  The past week has been a pretty rough roller-coaster  with the current administration&#8217;s and representative&#8217;s plans and  actions.  On top of everything, our traditional media outlets have done a  fine job of making it either feel like everything is going to be fine  or that the rapture is near (and neither are quite true in my opinion).</p>
<p>None of us know the future, all we have is today.  All of us,  together, have this day to make a difference, and to make a positive  impact within our family, our community, and our country.</p>
<p>What to do?  Well, there is sure enough complaining and throwing  hatred to go around.  Our job here at The Good American Post is to find  content and contributors that talk about positive and sustainable  people, places, and functions that protect our liberty and  constitution.  In our opinion, the <em>opportunity</em> to pursue anything  is the only thing worth fighting for, and that is the fight we are up  against now.</p>
<p>Today, take small steps to make positive impacts.  Start learning  about where your food comes from.  Find out who the troops protecting  this great country are in <em>your</em> community.  Volunteer to help a  cause, or start your own business where you can create development in  your local economy.  Ask questions, keep up to date on what is going on  with these threats to our constitution, however spend some time making  positive advances, not just worrying about all the things that are  wrong.</p>
<p>Because I can tell you, there are so very many things that are  right.  And for the little ones who have a future to grow up in, we need  to be using this time we have to work for a positive difference &#8211; it is  our duty.</p>

			<content:encoded><![CDATA[<p>Yesterday I found out my former elementary school was closing.  Today  I have read about 29 of 61 public schools being closed in Kansas City.</p>
<p>What we have here folks, is a real problem.  And I know that I am not  a politician, educator, or parent, but I am telling you that we better  figure out some type of solution about educating the most important  component of our economy and our country &#8211; our youth.</p>
<p>Many systems are flawed &#8211; politically, economically, and socially.   It is my belief that free-market systems may be the key to solving some  of these problems (notice that public education is completely dependent  upon federal and state government funding.  Considering the federal  government has no money (and is technically in the red), this means that  things like education get cut.</p>
<p>Solution?  We need to get back to where we educate our own kids or  pay someone to do it.  Painful?  Yes.  Smart?  Absolutely.  You cannot  put a price tag on education, and most of you know that public education  is not doing a whole lot of good for the future of our country anyway.</p>
<p>It&#8217;s time to stand up America, it is time to take responsibility and  control.  Let&#8217;s figure out a way to get back on track with educating our  kids and the future of this great country.</p>

<p>We will be taking a hard look at the Constitution of the United  States of America and the implications of the judicial involvement  within the words and interpretations of those words in the  Constitution.  Our inspiration comes from a phenomenal piece by Stephen  J. Markman, where it appeared in <em>Imprimis</em> in April of 2010.</p>
<p>Here we will outline, and continue in additional blog posts, the  cases that are made my Mr. Markman.</p>
<p><strong>1. Privileges or Immunities Clause</strong></p>
<p>Proponents of a &#8220;21st century constitution&#8221; or those that believe in a  &#8220;living constitution&#8221;  see the due process clause of the 14th Amendment  as a way to seek additional federal oversight into  state and local  laws.</p>
<p><strong>2. Positive Rights</strong></p>
<p>Again, using the privileges and immunities clause, proponents of the  21st century constitution may desire to change the Constitution from  being a guarantor of &#8220;negative liberties&#8221; into a charter of &#8220;affirmative  government&#8221; which would therein guarantee &#8220;positive rights&#8221; to people.   The Framer&#8217;s Constitution &#8220;defines individual rights in terms of what  the government <em>cannot</em> do to you,&#8221; (Markman, 2010), NOT what the  government should provide to you or guarantee you a right to (i.e.  Healthcare).  This has many potential negative implications for the  concept of liberty and the <em>opportunity</em> for prosperity (not a  guarantee of prosperity).</p>
<p><strong>3. State Action</strong></p>
<p>The requirement of state action as a precondition for the enforcement  of rights (as set forth in the due process and the privilege and  immunities clause), is another barrier for 21st century constitution  proponents. State powers (as re-emphasized in the 10th Amendment)  protect individuals and states from federal intrusions (i.e. protecting  states&#8217; funds from being manipulated or re-distributed to other states).</p>
<p><strong>4. Political Questions</strong></p>
<p>Federal courts are beginning to assert themselves into decisions  where the judiciary had never before been involved. In 1803, Chief  Justice John Marshall in <em>Marbury v. Madison</em> explicitly stated  that political questions were not to be made in court.  As recently as  2008, the Court decided upon a case dealing with foreign nationals, the  military, and prisoners of war (<em>Boumediene v. Bush</em>).  One can see  the implications from having the Court decide more and more political  questions.</p>
<p><strong>5. Ninth Amendment</strong></p>
<p>&#8220;Many 2st century constitutionalists understand this amendment to say  that there is some unknown array of unenumerated rights that lie fallow  in the Constitution, waiting only to be unearthed by far-sighted  judges&#8221; (Markman, 2010).  The 9th Amendment was created to emphasize the  limited power of our national/federal government &#8211; not leave this an  open-ended statement up for interpretation.</p>
<p><strong>6. Transnationalism</strong></p>
<p>This is the concept of having international law meld and mix with  domestic law.  This would make domestic judges more reliant upon foreign  laws to make decisions affecting the United States, and could  potentially open a pandora&#8217;s box of sanctions against people of this  country for &#8220;war crimes&#8221; and &#8220;violations of the Earth&#8221;.  And again, more  and more decisions would be given to judges as officials and  interpreters of the law.</p>
